Property Sold and Removed from Title


Overview

The owner of a property sometimes agrees to divide his land and sell part of it. This may be to facilitate the building of another house upon the sold part, or to extend the neighbour’s garden. It is quite easy to recognise this from the Title Register and Title Plan, and is important to note as it will have an effect on the legal boundary of the property.


The Title Register

When a property is sold to another person a new Title Register is created for the sold off part (B), and the Title Register for the retained part (A) is annotated with a new clause in Section A of the Title Register similar to the following:

3  (25.03.1995)  The land edged and numbered in green on the filed plan has been removed from this title and registered under the title number or numbers shown in green on the said plan.

Similarly, the sold off part of the land is given a new Title Plan that shows, edged in red, the new Title that the owner has been granted. The Title Plan for the retained land shows the area originally owned as edged in red, and drawn over this, in green ink, is the area sold off. Alongside the green edging is the purchaser’s new Title Number, in green print.

Although the boundaries are not shown with precision the revised shape and general dimensions are clearly shown.
