1 (1) In consideration of services provided to you by UKLRS as described on this web site you agree to make the appropriate payment and to be bound by these Terms and Conditions of Use and also to be bound, in so far as they apply, by:

1 (2) The information and documents we provide for you are electronic copies of authentic documents held by the Land Registries of England and Wales, Scotland, Northern Ireland, the Republic of Ireland, The Isle of Man and the Channel Islands and/or their agents, and other official bodies. We do not take responsibility for errors made by them. The information we provide is as provided by them. Neither we nor any third party shall be liable to you or to any third party for any loss or damage, direct, indirect, implied or consequential arising from any inaccuracy or incompleteness, or in delays in the delivery of the said information supplied via this web site. Neither shall we be responsible for loss of business, profits or damages arising therefrom, either in tort, contract, misrepresentation or similar.
1 (3) Electronic information processed over the internet or by email may be subject to delays or losses beyond our control. Neither we nor our information providers shall be liable for any losses arising therefrom.
1 (4) We agree to take payment from you by credit card. In consideration of this you agree not to cancel credit card payments made by you. Cancellation of credit card orders following a purchase on your behalf may result in both civil and criminal proceedings against you.
1 (5) You will be notified by email as soon as soon as your documents are ready (usually the same day of receipt of instructions if ordered during office hours). They will be uploaded to your MyAccount page on our website, and you will be able to access them straight away by logging in.
1 (6) When buying goods and services on the internet you are entering into a binding contract. The law which applies to this contract is UK law.
2 (1) It is inherent in our service to carry out your search as soon as possible after your order is placed. During office hours (9am to 5:30pm Monday to Friday) this may be within as little as 5 minutes (orders received outside of office hours are not usually processed until the morning of the first following office day). Therefore your acceptance of these Terms & Conditions is deemed to be your consent to begin to process your order prior to the end of your right of cancellation period (7 days), which means that once we begin to process your order you will no longer have the right to cancel as provided by the Distance Selling Regulations.
2 (2) Where you do not accept our Terms and Conditions we may still process your order, but will not be able to do so until your right of cancellation has expired, which means that we cannot begin to process your order until 7 days after it is made.
2 (3) Further, as our service is one which is to be provided within a period of less than 7 working days your right to a "cooling-off" period under the Distance Selling Regulations does not apply.
2 (4) You may still be entitled to cancel your order, where notice is given to us prior to our beginning to process your order (this is more likely to apply where the order has been made outside of office hours), although to do so you must strictly follow the procedure below.
2 (5) You must give us notice by email at cancellations@uklrs.co.uk before we begin to process your order using the number or email address below.
2 (6) In all cases you must quote your User ID, which is found at the top of all communications from us. Cancellation can only be accepted where we have not already begun to process your order.
3 (1) In carrying out our searches we incur disbursements and therefore refunds have been restricted to the following circumstances:
3 (1) (a) Where Registered Old Deed Searches are made but Old Deeds are not available, when another search cannot be substituted for it, e.g. a Title Register search, then the fee for the Registered Old Deed search will be refunded in full.
3 (1) (b) Where a a Folio Search is made in Northern Ireland but the property is unregistered a partial refund of £15 plus vat will be given.
3 (1) (c) Where a search is made at a cost exceeding £22 + vat and the property is unregistered, any sum paid in excess of £22 + vat will be reimbursed. The sum of £22 is retained by us to pay for the cost of establishing that the property is unregistered.
3 (1) (d) Discretionary refunds may be given, but only rarely. Any such will be at the sole discretion of UKLRS and will generally only be given in exceptional circumstances.
4 (1) You acknowledge that you do not acquire any property rights in database information provided to you either through ourselves or any one else from whom we have obtained the information.
4 (2) UKLRS and its logo are the trademarks of UKLRS and remain the property of UKLRS. Through your use of our website you may also access registered trademarks of database providers other than ourselves. Unless otherwise provided for under these terms and conditions, you are not provided any authorisation to reproduce or utilise UKLRS or other database provider trademarks or logos for any activity other than those prescribed under these terms and conditions. All trademarks remain the property of their registered owner.
5 None of these terms and conditions will be taken to be waived except by written notice signed by you and by UKLRS.
